These Terms & Conditions ("Terms") govern your access to and use of eatQuiz- BrainWar ("eatQuiz", "we", "us", or "our"), including our website at eatquiz.com and related mobile applications (together, the "Service"). By creating an account, signing in, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1Eligibility & Accounts
- You must be at least 13 years old (or the minimum digital consent age in your country) to create an account. If you are under the age of majority where you live, you confirm you have permission from a parent or guardian to use the Service.
- You may sign in with a Google account or play as a guest. If you use Google Sign-In, you are responsible for maintaining the security of that account.
- You agree to provide accurate information and to keep your account secure. You are responsible for all activity that occurs under your account.
- One player may not maintain multiple accounts to manipulate rankings, matchmaking, hearts, or coins.
2The Service
eatQuiz is a real-time, multiplayer brain-training game in which players are matched with opponents of similar rating and compete across a series of mini-games testing speed, memory, calculation, and perception. Features include hearts (used to enter matches), coins (an in-app virtual currency), ratings, leagues, leaderboards, friends, and player-to-player challenges. We may add, modify, or remove features, mini-games, or content at any time.
3Acceptable Use & Fair Play
When using eatQuiz, you agree that you will not:
- Use bots, scripts, macros, emulators, or any automated or third-party tools to play matches or otherwise interact with the Service;
- Exploit bugs, glitches, or errors, or attempt to reverse-engineer, decompile, or tamper with the Service or its backend systems;
- Collude with other players to manipulate match outcomes, ratings, or leaderboard rankings;
- Harass, threaten, impersonate, or abuse other players or eatQuiz staff, including through display names, avatars, or the Contact Us feature;
- Upload or transmit content that is unlawful, defamatory, obscene, hateful, or infringes another person's rights;
- Attempt to gain unauthorized access to another player's account or to any part of the Service's infrastructure;
- Use the Service for any commercial purpose not expressly authorized by us.
We may investigate suspected violations and take action, including resetting rating, removing virtual items, or suspending or terminating accounts, as described in Section 8.
4Virtual Items — Hearts & Coins
- Hearts regenerate over time and are consumed to enter ranked matches. Solo training does not consume hearts.
- Coins are earned through gameplay, daily challenges, or (where enabled) requested via the in-app or WhatsApp coin-request feature, and may be used to refill hearts or unlock cosmetic items.
- Hearts and coins have no real-world monetary value, cannot be exchanged for cash, and are not transferable between accounts.
- We may adjust the availability, balance, earn rates, or mechanics of hearts, coins, ratings, or leagues at any time to maintain fair and balanced gameplay.
- Virtual items are forfeited without compensation if your account is suspended or terminated for violating these Terms.
5User Content
"User Content" means any display name, avatar selection, or message you submit through the Service, including via the Contact Us form. You retain ownership of your User Content, but you grant eatQuiz a non-exclusive, worldwide, royalty-free license to display, store, and transmit it as needed to operate the Service (for example, showing your display name and avatar to other players). You are solely responsible for the User Content you submit and confirm it does not violate these Terms or any applicable law.
6Intellectual Property
The Service, including its name, logo, mini-games, design, graphics, code, and all related intellectual property, is owned by eatQuiz- BrainWar and its licensors and is protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial entertainment purposes, subject to these Terms. You may not copy, modify, distribute, sell, or create derivative works based on the Service without our prior written consent.
7Third-Party Services
The Service relies on third-party providers, including Google Sign-In and Google Firebase (authentication, real-time database, and messaging), and may display advertising through Google AdMob. Your use of these third-party services is also subject to their own terms and privacy policies. We are not responsible for the availability, content, or practices of third-party services outside our control.
8Suspension & Termination
We may suspend or terminate your access to the Service, in whole or in part, at any time and without prior notice, if we reasonably believe you have violated these Terms, engaged in cheating or abusive behavior, or created risk or legal exposure for eatQuiz or other players. You may stop using the Service and request deletion of your account at any time by contacting us as described in Section 14. Sections of these Terms that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, and Governing Law) will continue to apply.
9Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that matchmaking, rating, or leaderboard results will meet your expectations.
10Limitation of Liability
To the fullest extent permitted by applicable law, eatQuiz- BrainWar and its developers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, virtual items, rating, or goodwill, arising out of or related to your use of, or inability to use, the Service, even if we have been advised of the possibility of such damages. Our total aggregate liability arising out of these Terms or the Service will not exceed the amount, if any, you have paid us in the twelve (12) months preceding the claim. Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
11Indemnification
You agree to indemnify and hold harmless eatQuiz- BrainWar, its developers, and affiliates from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your User Content, or your violation of these Terms.
12Governing Law & Disputes
These Terms are governed by the laws of India, without regard to conflict-of-law principles, unless otherwise required by mandatory local law where you reside. Any dispute arising out of or relating to these Terms or the Service will first be attempted to be resolved informally by contacting us. If a dispute cannot be resolved informally, it will be subject to the exclusive jurisdiction of the competent courts, except where applicable law requires otherwise.
13Changes to the Service & Terms
We may modify these Terms from time to time. When we do, we will update the "Last updated" date above and, where changes are material, provide additional notice within the app. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
